Laws and Policies Affecting Michigan Schools

On June 24, 2004, Governor Granholm signed legislation (2004 PA 165 and 166), effective immediately, pertaining to HIV/AIDS and sex education programs in Michigan public schools.  The law requires that local sex education advisory boards include half of its members as parents, that sex education programs emphasize abstinence, and that they address eleven specific issues detailed in PA 165.  PA 166 establishes a complaint process for parents.  If the process does not result in compliance, schools can lose up to one percent of their state aid.

Oct 21, 2004 Letter from MDE Identifying Tasks and Timelines for School Districts

This letter provides local school districts and their staff with guidance as they are working with your programs to meet the new sex education legislation (2004 PA 165 and 166) signed by the Governor on June 24, 2004.  The recommendations pertain to those school districts that teach reproductive health and/or sex education.

In September of 2003, the Michigan State Board of Education passed a policy regarding sex education.  The policy recommends that local school districts select, adopt, and implement comprehensive sexuality education programs that are based on sound science and proven principles of instruction.

This document includes a compilation of the current Revised School Code (PA 451 of 1976) and State School Aid Act (PA 94 of 1979) provisions regarding the teaching of HIV/AIDS, sex education, health education, and physical education in Michigan schools.

This compilation document identifies all additions and deletions to the School Code and the State School Aid Act triggered by Public Acts 165 and 166.

Application for Sex Education Supervisor 

The Department asks that every district providing reproductive or sex education, per the Michigan School Code (§380.1506, §380.1507, §380.1507b), also complete a Request for Approval of Sex Education Supervisor form.  The role of a program supervisor is established in law (§380.1506) and facilitates communication between the Department and local districts on HIV/STD and sex education updates.

District Sex Education Survey (Due December 3, 2004)

The Michigan Department of Education requests that every local education agency, public school academy, and separately governed intermediate school district center program complete a survey to assess the status of HIV/STD and sex education in Michigan schools.  For an online copy of the survey and accompanying materials click here to move to the MDE website.
